Service Agreement

This service agreement (“agreement”) is made between parties Customer (“client”) and DiasporaTV, located in Yonkers, NY 10704, USA. Both parties shall abide by this agreement. All revisions to this document can be found on our website at www.DiasporaTV.com. DiasporaTV may post revisions to this agreement without notification.

Service

DiasporaTV offers prepaid subscription-based service that requires a SmartBox (HD) receiver (“receiver”). Parties agree on the following services that DiasporaTV provides:

  • Albanian Internet Protocol Television (IPTV) channels;
  • Live streaming and channels available in New York (EST) time zone with 24-hour rewinding capability;
  • Video On Demand (VOD) with wide selection of Albanian DVD titles available;
  • Digital Video Recording (DVR) that enables recording favorite shows.
    • Recording can be scheduled or enabled by pressing a single button.
    • This feature is only available if a USB Flash Drive (not included) is connected to the DiasporaTV receiver;
  • Large selection of radio stations;
  • Browsing and sharing of photos, videos, and songs from any computer connected to same network as the receiver;
  • Web surfing, instant messaging, e-mails, weather forecasts, accessing YouTube, etc.

System Requirements

In order to use DiasporaTV service, client must have a TV set with RGB, RCA or HDMI connections and internet access (cable or DSL) installed already. Minimum internet speed required is 1.2 mbps (megabits per second). Because internet connections vary in speed, it is suggested that the client have 2 mbps or more available for the DiasporaTV service to work.
Only receivers purchased at DiasporaTV can work with the DiasporaTV platform.

Prices

DiasporaTV offers 12-month prepaid subscriptions. The client must have a SmartBox (HD) receiver in order to access DiasporaTV service. The receiver is a one-time purchase by client at the beginning of service. For service renewal, client must only pay subscription plan, and not receiver.
If the receiver is damaged by the client and the client purchases another receiver, the price of the receiver is shown on the “POROSIT TANI” page on www.DiasporaTV.com. Alternatively, the client can contact DiasporaTV to inquire about the price of the replacement receiver. If the client wishes to purchase a replacement remote control, the price of the remote control is $15 USD + shipping.

Shipping

For clients in U.S.A., Western Europe and Australia, DiasporaTV will ship the receiver with USPS. For clients in Canada, DiasporaTV will ship receiver via UPS.
The shipping fee is determined at the time the order is made and the fee given to customer or it can also be found on the POROSIT TANI link at top of every page. The shipping price and other pricing information can be found on the POROSIT TANI page on www.DiasporaTV.com. All shipping charges are in addition to DiasporaTV receiver and service charges. After payment is processed, client will be sent a tracking number to follow the order package as well as view an approximate delivery time as provided by shipping carrier. In any case of returning equipment to DiasporaTV, the client is responsible for all shipping charges.
The following items will be included in the shipping package:

  • One (1) SmartBox (HD) receiver pre-programmed specifically for client;
  • Power adapter designed to work specifically with SmartBox (HD) receiver. Do not use a different power adapter than the one included in the shipment, as it can lead to the receiver being damaged and that is not covered by warranty;
  • Advanced Infrared Remote Control;
  • Network cable (3 feet long) that connects the SmartBox (HD) receiver to your cable modem or router. If you need a longer cable, you can purchase at any electronics stores. The cable is identified as CAT5 network cable with RJ45 connectors;
  • One (1) RCA cable (3-colored cable) that connects SmartBox (HD) receiver to television;
  • One (1) HDMI cable that connects SmartBox (HD) receiver to television;
  • The following documents:
    • Order Receipt;
    • Installation Manual;
    • Marketing Information.

Clients can make payments using the methods listed below. All money orders and checks should be mailed to:

Debit/Credit Card

This payment method is available to clients in U.S.A., Canada, Western Europe and Australia.
DiasporaTV accepts debit/credit card payments. Client must provide card information in the order form on the POROSIT TANI page on www.DiasporaTV.com and the payment will be processed within 24-hours. When paying with a debit/credit card, for the security of the client and DiasporaTV, internet information about the client will be retained as proof that client has willfully made the order. After payment is successfully processed, DiasporaTV will ship the receiver or will renew the service for the client.

Money Order

This payment method is available to clients in U.S.A. and Canada only.
Client can make payment with money order payable to DiasporaTV and mail it to the address written above. As soon as DiasporaTV receives and processes payment, the receiver will be shipped to the client or the service will be renewed for the client.

Western Union

This payment method is available to clients in U.S.A., Canada, Western Europe and Australia.
Client can make Western Union payment for DiasporaTV services. After the order is made, the DiasporaTV system will automatically send the client an e-mail with detailed information regarding payment via Western Union. After the payment is made, client must send us payment information by clicking the link included in the original e-mail by DiasporaTV. After the payment is processed, DiasporaTV will ship the receiver to the client or renew service for the client.

MoneyGram

This payment method is available to clients in U.S.A., Canada, and Western Europe and Australia.
Client can make MoneyGram payment for DiasporaTV services. After the order is made, the DiasporaTV system will automatically send the client an e-mail with detailed information regarding payment via MoneyGram. After the payment is made, client must send us payment information by clicking the link included in the original e-mail by DiasporaTV. After the payment is processed, DiasporaTV will ship the receiver to the client or renew service for the client.

Check

This payment method is available to clients in U.S.A. and Canada only.
Client can make payment with a check payable to DiasporaTV and mail it to the address written above. As soon as DiasporaTV receives and processes payment, the receiver will be shipped to the client or the service will be renewed for the client.

Refund Policy

Potential client will be thoroughly informed about DiasporaTV service and its contents. After having been explained all the information, potential clients decide whether to become actual DiasporaTV clients. All of the information communicated to potential clients is also presented on our website www.DiasporaTV.com. DiasporaTV is always ready to help its clients with any technical-related difficulties, as outlined in this service agreement.

Payments non-refundable under any circumstances:

  • The SmartBox (HD) receiver (with any of its parts) is not refundable under any circumstances;
  • Used months in a subscription plan are not refundable;
  • Shipping costs are not refundable.

A refund will be issued only if:

Client does not receive DiasporaTV service for one (1) month at a time due to technical faults on DiasporaTV’s end. In this case, upon request, client can be refunded unused subscription months but not the used months.

A refund will not be issued if:

Client has DiasporaTV service and: service is acceptable, there are no service interruptions over thirty (30) days at a time, DiasporaTV staff is ready and willing to assist in troubleshooting technical problems, then the client will not be granted a refund.

Cancellation Policy

Client has right to cancel service if:

  • Client does not receive service from DiasporaTV for one (1) month. In this case, client has the right to cancel service and all of unused months in the subscription plan will be credited back to client, including the month that service was not used.
  • Client does not receive proper assistance from DiasporaTV technicians as outlined in this service agreement. In this case, client should ask to speak to an available manager at DiasporaTV; if the client is still unsatisfied after all support is provided as per this document, the request to cancel service will be approved. Upon such approval, the client will be credited back the unused subscription months but not other costs that were added to original order (such as shipping, receiver, etc.).
  • Subscription plan expires and client does not renew. Unless client calls to renew subscription, the service will automatically stop at expiration date. Client can keep their DiasporaTV receiver and whenever client decides to continue service, DiasporaTV will enable service on the same receiver that the client has.

Client cannot cancel service if client:

  • Initiates a charge-back (dispute with their card bank) despite DiasporaTV’s complete adherence to this service agreement.
  • Has DiasporaTV service and receiver from DiasporaTV. Client cannot cancel service with the reasons similar to “I do not like the TV stations or the content offered in the DiasporaTV service”. The reason for this is because:
    • DiasporaTV has no control over the content of TV stations broadcasted in its package;
    • Each client is thoroughly informed about the DiasporaTV channels and type of content prior to ordering service from DiasporaTV. Because the client chooses to order DiasporaTV service after being informed and fully aware of our TV stations and content, client cannot cancel service.

Warranty

The receiver has 1-year warranty only for software-related problems. No other problems are covered by the warranty. Accessories (remote control, power adapter, cables, etc.) are not covered by the warranty. Shipping expenses for receiver inspections are paid entirely by the client.

In the shipping package, client can find the user manual that explains how to install the receiver. If client has trouble installing the receiver, it is best to visit www.DiasporaTV.com and click on the “Support” link. If client cannot find help on our support site, client should call DiasporaTV to get assistance from a DiasporaTV technician. All client requests that are not present on our website support will be added by our technicians.
