This service agreement (“agreement”) is made between customer (“client”) and DiasporaTV, located in Yonkers, NY 10704, USA. Both parties shall abide by this agreement. All revisions to this document can be found on our website at www.DiasporaTV.com. DiasporaTV may post revisions to this agreement without notification.

Service

DiasporaTV enables watching TV channels via IPTV technology. Both parties agree on the following service that DiasporaTV offers:

  • Watching live TV channels via IPTV, without the need for satellite antenna;
  • Watching time-shifted TV channels in New York timezone (EST) and the last 24 hours, as per client’s preference;
  • Video On Demand (VOD) – large selection of Albanian DVD projects in various categories, such as movies, music, humor, etc;
  • Large selection of Albanian radio stations;
  • Watching YouTube videos broadcast free-of-charge by YouTube and rights owned by each publisher.

System Requirements

DiasporaTV functions only if client has device with Android OS. Such device can be a smartphone, tablet, set-top box (STB), etc. and it can be connected to a TV set. Client must also have an internet connection available on the device. The necessary internet speed for DiasporaTV to function without interruptions is 2 mbps (megabits per second) for Standard Definition (SD) content, and 4 mbps for High Definition (HD) content. Internet speed varies in all countries so it is suggested that the client has minimum internet speed of 4 mbps. If client’s internet speed falls under 2 mbps, it is very likely that the client will have trouble with receiving DiasporaTV signal.

DiasporaTV sells the SmartBox set-top box but clients can order and use other devices online, in which case DiasporaTV is not responsible regarding devices. DiasporaTV only offers service for watching IPTV channels. DiasporaTV does not own video materials that are broadcast in its platform.

Products

DiasporaTV sells the SmartBox set-top box, a device that offers clients easy access to DiasporaTV service. Clients are not required to buy/use the SmartBox set-top box and have the option to use other Android-based devices with DiasporaTV service. SmartBox set-top boxes come with a 30-day warranty which allows clients sufficient time to test and return the set-top box for an exchange if it does not function as necessary.

Prices

DiasporaTV offers prepaid subscriptions. Service prices and occasional changes are posted on the DiasporaTV website. Client must have device in order to access DiasporaTV service.

Payment Methods

Payments for DiasporaTV service can be made via debit/credit cards, checks, money orders, or via Money Transfer Services. Interested parties can make payments in the following methods.

Debit/Credit Card

This payment method is available to clients in U.S.A., Canada, Western Europe and Australia.

DiasporaTV accepts payments with debit and credit cards. When an order is placed, client can input their card information in the DiasporaTV order form and payment will be processed automatically. In case when client pays with a card, DiasporaTV stores client’s internet information for security purposes and as proof that client has placed the order. After payment is processed sucessfully, DiasporaTV system will automatically activate client’s subscription for the selected period.

Accepted cards are: Visa, MasterCard, American Express, JCB (only for U.S. clients), Discover (only for U.S. clients), and Diners Club (only for U.S. clients).

Check/Money Order

This payment method is available to clients in U.S.A. and Canada only.

Client can make payment via check or money order payable to “DiasporaTV” and send the payment to address below. After payment is received and processed, service will be activated. Processing time may take up to 2 business days. Payments via check or money order must be mailed to:

Money Transfer Services

This payment method is available to clients in U.S.A., Canada, Western Europe and Australia.

Client can make payment via Money Transfer Services. After order is placed with DiasporaTV, client must contact DiasporaTV to obtain information regarding payment via Money Transfer Services. After payment is made by client, client must contact and inform DiasporaTV with payment details. After payment is processed, service will be activated. Payments made via Money Transfer Services may take up to 5 business days to process.

Refund Policy and Cancellation Policy

Potentialclients will be thoroughly informed about DiasporaTV service and its contents. After having been explained all the information, potential client will decidewhether to become a DiasporaTV client. The same information communicated topotential clients is also presented on our website www.DiasporaTV.com.DiasporaTV is always ready to help clients with any questions or requests thatclient may have, as outlined in this agreement.

Service is non-refundable if:

  • Service time already used by client;
  • Client initiates dispute/chargeback (with their bank) before contacting DiasporaTV for assistance and/or after DiasporaTV has fulfilled all service requirements, as outlined in this document;
  • Client receives all DiasporaTV services in order. Reasons such as “I don’t like the channels and/or the TV shows that are broadcast”, client will not be offered a refund because:
    • DiasporaTV is notresponsible for content that is broadcast by TV stations;
    • Before signing up,client is informed by DiasporaTV about content that is broadcast.

Client has right to cancel service only if:

  • Client does not receive service from DiasporaTV in total of one (1) month. In this case, client may request service cancellation and receive partial payment for remaining, unused time (including time service was not provided);
  • Client does not receive technical support, as outlined in this document. In this case, client must first request to communicate with a DiasporaTV manager and, if still no technical support is provided as outlined in this document, client may request service cancellation and receive partial payment for remaining, unused time (including time service was not provided);
  • Client selects automatic/recurring payment processing during order. Client may request cancellation of automatic/recurring payment. DiasporaTV will refund the full renewal amount after subtracting 1) time that service was used, or 2) 1 month – whichever is longer.

Product Return and Exchange Policy

Product Return

SmartBox set-top boxes sold by DiasporaTV can be returned for any reason within the first 30 days, which start from the time when the set-top box was delivered by the postal service. The SmartBox set-top box, including all the accessories and packaging, must be received in the exact same condition as it was when sent to the client, otherwise DiasporaTV will deduct an amount assessed on case-by-case basis. All shipping charges are paid by client and are, thus, non-refundable.

Product Exchange

SmartBox set-top boxes sold by DiasporaTV can be returned for exchange within the first 30 days, which start from the time when the set-top box was delivered by the postal service. All shipping charges are paid by the client and are, thus, non-refundable.

Technical Support

DiasporaTV can only provide support for its application and its service. Any problems outside this scope will not be addressed because of the many factors involved.

Client can receive technical support from DiasporaTV as follows: 1) via e-mail, by sending an e-mail to support@diasporatv.com, 2) on the “Support” section that can be found on www.DiasporaTV.com/support, and 3) via telephone numbers listed on the “Contact” page.
